What a 'Reading Request' Means
In Brazilian judicial procedure, a reading request (pedido de vista) is a mechanism through which a justice, when determining that more time is needed to review a case, temporarily halts proceedings. According to BBC reporting, the justice filing the request is granted up to 90 days for review, and the deadline for this case ends in December of this year. If Justice Dino does not submit a separate opinion within that time, the case will automatically return to the agenda for further consideration without additional rulings. In other words, the fact that this meeting ended without conclusion does not mean the case has been closed; rather, final judgment must be rendered by year-end at the latest.
The Conflict Behind the Meeting
According to G1 reporting, this conflict began when Justice André Mendonça, who is handling the Banco Master case, expanded the scope of declassification of the federal police report. The released documents contained 52 messages exchanged between banker Daniel Borcarou and Justice Moraes, details of face-to-face meetings between the two, and a contract valued at 130 million reais (1억3000만 reais) between the law office of Justice Moraes's spouse and Banco Master. Justice Moraes countered that Justice Mendonça had selectively disclosed documents, and Justice Mendonça explained that he kept only the necessary portions confidential to protect ongoing investigations and third-party information. President Fachin had once decided to handle the two matters separately, but when discussion arose in this meeting about merging them again, the conflict reignited. G1 reported that this internal conflict could also affect discussions on the establishment of judicial ethics regulations.
Other Justices Are Also Involved
Justice Cássio Nunes Marques recused himself from participating in the proceedings regarding Justice Moraes. According to VEJA reporting, this decision came after the publication of a conversation in which Borcarou allegedly made payments to Nunes Marques's son, a lawyer, and the opposition expressed disappointment, viewing the recusal as capitulation to pressure from other justices. Meanwhile, Justice Nunes Marques himself maintained the position that this recusal only applies when there are election-related issues, and conveyed to associates that he could handle the Banco Master case itself again.
